A new period could be considered seniority in employment. The law targets millions of Romanians in 2024.

There is new news for Romanians interested in seniority in employment. A new legislative proposal recently registered at the Senate, for which the initiators are asking for adoption under emergency procedure, provides for the equalization of treatment between the mandate contract and the employment contract in terms of recognizing certain periods for seniority in employment.

More specifically, all persons who work on the basis of a mandate contract would no longer be disadvantaged when applying for state jobs, for example, where seniority in employment is required in most cases.

The initiators of the legislative proposal also propose that it should amend the Labor Code and the Companies Law. In this sense, a new chapter dedicated to the mandate contract would appear in the Labor Code, although the mandate already has a regulation in the Civil Code.

The main changes proposed by the draft law are:

• The period during which a person performs a mandate contract will be considered seniority in employment, both for the purpose of calculating rights derived from seniority in employment (such as seniority bonus, additional leave, etc.), and for the purpose of fulfilling the conditions for occupying certain positions or functions.

• The mandate contract will be considered an equivalent of the employment contract in terms of the calculation of seniority in employment. This means that the period during which a person performs a mandate contract will be added to the period during which he/she has worked under an employment contract for the purpose of calculating seniority in employment.

• The mandate contract will be considered an equivalent of the employment contract in terms of the fulfilment of the conditions for occupying certain positions or functions. This means that the period during which a person performs a mandate contract will be counted towards the fulfilment of the conditions of seniority in employment required for occupying certain positions or functions.

The draft law is currently in the analysis and debate stage at the Senate. If adopted, it would have a significant impact on millions of Romanians who work on the basis of a mandate contract.
