Addressing the Acute Shortage of Legal Personnel: A Growing Concern

The legal profession is grappling with a severe shortage of personnel, as magistrates find themselves overwhelmed by an ever-increasing caseload. Nationally, a staggering 13% of judicial positions remain vacant, with an additional 8% vacancy rate specifically in the judiciary sector in Bucharest. The shortage extends to the prosecutor's office, exacerbating the strain on law enforcement agencies.

The shortage of personnel has significantly hampered the efficiency of criminal investigations, leading to delays in case processing and, in many instances, resulting in the closure of cases due to prolonged inactivity. The mounting workload, particularly among magistrates, including prosecutors and judges, has become an enduring challenge, hindering the timely delivery of justice.

Seeking Solutions

Efforts to address this pressing issue have been ongoing, with the recent publication of psychological assessment results by the Supreme Council of Magistracy (CSM) for prospective candidates entering the legal profession. However, with only 15% of candidates passing the assessment out of 238 applicants, it underscores the magnitude of the challenge in recruiting and retaining qualified legal professionals.

Path Forward

The legal community continues to advocate for systemic reforms aimed at attracting and retaining talent within the judiciary. Initiatives to alleviate the burden on magistrates, such as improved working conditions, competitive remuneration packages, and targeted recruitment drives, are essential to bolstering the legal workforce and ensuring the effective administration of justice.
