Romania Adopts "Fugitive Pays" Law to Recover Repatriation Costs

The Romanian Chamber of Deputies has decisively adopted a draft law initiated by the Ministry of Justice that establishes the procedure for determining judicial costs in the case of fugitives who have evaded criminal prosecution or trial, as well as the procedure for recovering the costs incurred in bringing them back to Romania.

Key Provisions of the Law

  • Cost Recovery for Fugitive Apprehension: The costs associated with apprehending individuals who evade criminal prosecution or trial will be considered when determining judicial expenses.

  • Right of Recourse for Enforcement Costs: For costs related to apprehending fugitives evading punishment enforcement, Romanian authorities will have a right of recourse to the competent civil court.

Combating Fugitive Phenomenon

The draft law aims to curb the phenomenon of "fugitives" and discourage this criminal behavior. By imposing financial consequences on those who evade justice, the law seeks to deter individuals from fleeing and incentivize their return to face the legal process.

Minister of Justice Remarks

"Fugitives must think twice before fleeing Romanian justice. This is because the 'Fugitive Pays' law was adopted today by Parliament, the Chamber of Deputies to be exact, and is going to be promulgated. It is known that some of the convicts have discovered their talents as criminal athletes, but you know that the Romanian state spent almost 10 million lei in 2023 to bring these fugitives back. The Ministry of Justice has made this common-sense bill. You fled justice in the country, when you return, you pay for your return to the country, not the Romanian state," said Alina Gorghiu about the draft law that passed through Parliament.

Impact and Implications

The adoption of this law is expected to have a significant impact on deterring individuals from evading justice and encourage their return to face the legal process. It also aims to ensure that the Romanian state is not burdened by the financial costs associated with apprehending and repatriating fugitives.
